The Small Claims Court Process

Small Claims Court, although designed to be user-friendly, operates according to formal rules and procedures. The process typically involves:

  • Issuing the claim: commencing the process by filing the correct documents.This is about addressing wrinkles if the other party is unaware of the claim.
  • Defenses and counterclaims: the defendant’s reply or challenge.
  • Settlement conferences: required meetings when parties discuss settlement options before trial.
  • Trial: in the event of no settlement, both sides will present evidence and arguments to a judge.
